General terms and conditions of sale

Preambule :

The lemon-story.com site is published by the company LEMON STORY, SAS with capital of €10,000, registered with the RCS of Paris under number 845186535.

The site is powered and hosted by Shopify.

The following general terms and conditions apply exclusively to current and future commercial relations existing between LEMON STORY SAS – 1210 Chemin St Augsutin 83260 La Crau (“we”) and the customer placing an order (“you”).

We may modify these general terms and conditions of sale at any time subject to making these modifications appear on our site.

By accepting these General Terms and Conditions of Sale and Use, you declare that you have reached the age of majority in your country, state or province of residence, and that you have given us your consent to allow any underage person in your charge to use this website.

The use of our products for any illegal or unauthorized purpose is prohibited and you must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to the laws relating to copyright).

You must not transmit any worms, viruses or any other code of a destructive nature.

Any infringement or violation of these General Terms and Conditions will result in the immediate termination of your Services.

Article 1: Orders

We undertake to accept your order under the terms of these general terms and conditions. When you order, we inform you of the availability of the products you wish to order. However, if despite our vigilance the products prove to be temporarily unavailable (out of stock, reissue, etc.) after your order, we will inform you by e-mail and invite you to cancel or modify your order. If the products prove to be permanently unavailable (end of stock, etc.) after ordering, we will automatically cancel your order and inform you by e-mail before proceeding to reimburse any sums paid for the missing products.

By confirming your order, you accept all of these general terms and conditions made accessible on our website, and acknowledge that you have perfect knowledge of them, thereby waiving the right to rely on any contradictory document, and in particular your own general conditions of purchase, the act of purchase entailing acceptance of these general terms and conditions. This confirmation as well as all the data that we have recorded will constitute proof of our transactions.

Article 2 : Prices

The prices indicated in euros are deemed to include all taxes according to the rates in accordance with French taxation, excluding shipping costs. We reserve the right to change our prices at any time. We undertake to apply the current prices which were indicated to you at the time of your order.

Article 3 : Payment

The price is due immediately on the date of the order. Cards issued by banks domiciled outside France must be international bank cards. Secure online payment by credit card is completely secure: it uses the SSL (Secure Socket Layer) protocol. The information transmitted are encrypted by software and cannot be read during transport over the network. We have selected the online payment solution Shopify Payment (Stripes). Your order can only be processed from the moment your payment has been accepted and this acceptance transmitted to our services via the Shopify Payment (Stripes) site.

Article 4 : Delivery

Unless otherwise specified, delivery is made to the address you indicated when ordering. Delivery times are only indicative unless, exceptionally, we have committed to respect a specific delivery date. We invite you to read the additional information related to delivery.

The products are delivered by Colissimo. If the customer is absent during delivery, the package is kept for 10 days by the post office to which the buyer depends.

If you do not receive the package, you have 3 weeks to make a complaint.

Delivery costs are free for any order over €80 including tax. And for all orders worth less than €80 including tax, the delivery costs are €11.99 including tax for Colissimo delivery. Delivery times are estimated at 2 working days for mainland France.

Orders placed on Saturdays or Sundays are processed the following Monday. Orders placed on a public holiday are processed the next business day.

For delivery by courier in Paris, we use the Stuart service. Delivery costs can vary depending on the order and the place of delivery. Delivery is only possible during store opening hours, within a 10km radius around Paris.

Article 5: Cancellation, withdrawal, reimbursement and complaint

We guarantee the quality and good condition of all the items we send.

1/If you wish to cancel an order, before it is sent, in whole or in part, please make your request by email to customer service.

2/In accordance with articles L.121-20 et seq. of the Consumer Code, you have a period of 14 working days from the date of delivery of your order to return all or certain item(s) not suitable to you and request a refund. In all cases, return shipping costs remain at your responsibility.

The return request is an essential condition for acceptance and reimbursement of the returned product(s) within 14 working days following the receipt.Only the customer who placed the order has the power to exercise his right of withdrawal.

Simply send us a message via the contact form on our site. Upon receipt of your request, we will contact you to organize the return of the products.

We will check the conformity of the returned product(s), undamaged and unopened, for definitive acceptance of the refund, upon receipt of the returned products with the delivery slip.

The refund will be made via the payment method used during the purchase within 14 days.

3/The replacement of any item damaged during transport can be done upon presentation of pictures of the Colissimo label with the tracking number, the damaged item and the package with the contents.

4/In the case of an order returned to our premises, for the following reasons from our transporter : unclaimed or refused, without having made a request for withdrawal, we will make a refund by deducting transport costs.

5/For complaints regarding the quality of an item, please send us an email using the customer service contact form, specifying the following information: your contact details, the reason for the complaint, a photo, the expiry date appearing on the product, and the internet order number.

Article 6: Reservation of ownership

Article 7: Guarantee of hidden defects and liability

In the event that the products we have delivered to you present a hidden defect, we may, at our option, eliminate this defect or replace the defective product with another. If we do not want to eliminate this defect or replace the defective item, or if we are unable to do so, or if we cannot do so within the deadline due to factors which depend neither on our will nor on our doing, You can, at your option, return it to us for reimbursement of the price and return costs or ask us for a reduction of the sale price. The products offered comply * with current French legislation.

We undertake to provide all the care that is customary in the profession for the implementation of the service offered to the customer. However, we cannot be held liable in the event of failure to fulfill our contractual obligations due to a fortuitous event or a case of force majeure such as, and without limitation, catastrophes, strikes, fires, floods, or defect of breakdown of equipment, means of transport or communication or as a result of your actions.

Furthermore, we will not be held liable in the event of a delay due to products being out of stock or in the event of an error in the presentation of the products on our site, the photographs, texts and illustrations representing the products being not contractual.

Article 8: Protection of personal data

We are committed to protect your personal data. By adhering to these general terms and conditions, You acknowledge having read our confidentiality commitment and consent to our collection and use of this data. Our website has been the subject of a prior declaration to the Commission Nationale de l’Informatique et des Libertés (CNIL) under the number 2080389.

Article 9: Applicable law and competent jurisdiction

These general terms and conditions are subject to French law and the Vienna Convention on Contracts for the International Sale of Goods, to the exclusion of United Nations sales law. All disputes relating to the commercial relationship existing between you and us are subject to the exclusive jurisdiction of the French courts and more particularly the courts of Paris.
